1. Introduction

Welcome to the HASHWallet application and website (the “Platform”, or “we” or “us” collectively). Below, we detail the licence agreement that governs the terms on which you, as a User, may use the Platform and the Services offered therein.

This document (together with all documents referred to herein) sets out the terms and conditions governing the use of this Platform and the use of the Service provided through this Platform ("Terms and Conditions"). Please read these Terms and Conditions and our Privacy Policy and Cookie Policy carefully before using the Platform.

By using the service provided on this Platform, you agree to be bound by the Terms and Conditions, as well as our Privacy and Cookie Policy. If you do not agree, you should not use this Platform. If you have questions, please contact us through our usual channels.

3. Users and consent

The use of the Platform attributes the condition of the User, who accepts these Terms and Conditions from the moment of use. The User declares that the use of this Platform is personal and non‑professional. The Platform allows access to the Services specified herein.

Before using the Services, the User should be aware of the risks of buying, selling or holding Cryptoassets. Values can vary considerably and there is a substantial risk of loss. Cryptoasset services are not regulated by Spanish financial authorities nor covered by clearing schemes. Consider whether trading or holding cryptoassets is appropriate for you.

4. Use of the platform and return of the product

ESIGNUS offers through the Platform the purchase of hard Wallets (physical devices that allow the safekeeping and protection of private keys).

• Once the product has been purchased and used, you will lose your right of withdrawal under Article 103 of the Law on Consumers and Users.
• If it has not been used, you have 14 days to return it (sealed and packaged as received).

To initiate a return, email ceo@icapitalventures.io with subject “return”.

The User shall activate the device in accordance with the instructions for use contained in these T&Cs and undertakes to make appropriate use of the Service, not to (by way of example): engage in unlawful activities; disseminate prohibited content; damage systems or introduce malware; or use ESIGNUS Intellectual Property for personal gain.

5. Exclusion of warranties and liability

ESIGNUS may interrupt access to the Services at any time and without prior notice for justified reasons. We do not guarantee reliability, availability or permanent continuity of the Platform or Services; use is at your own risk. ESIGNUS accepts no liability arising from misuse of materials, third‑party links, tool malfunctions, communication failures, user password errors, viruses or other harmful elements, or the non‑operability of the email provided by the User.

Blockchain protocols, forks and modifications. ESIGNUS does not own or control underlying blockchain protocols. Protocols may change, including via forks. ESIGNUS may temporarily suspend operations and decide whether to support a protocol, and assumes no responsibility for consequences arising from such changes.

6. Services offered via the platform

Purchase of hard Wallets. You can access the marketplace via the web to purchase the product (hard Wallet). Follow the activation instructions at https://support.gethashwallet.com. Use of the Service requires acceptance of these Terms.

7. Other user prohibitions

Without limitation, the User shall refrain from: unlawful or immoral use; publishing offensive or infringing content; exploiting vulnerabilities; unauthorised account sharing; scraping or automated monitoring; spam; restricting third‑party access; attempting to breach security; extracting materials by unauthorised means; deep‑linking or framing; overloading infrastructure; or using meta tags with ESIGNUS names or IP. ESIGNUS may deny or withdraw access without notice for violations.

8. Right of withdrawal

As per Article 103 of Law 3/2014 of 27 March, the transactions covered here are excluded from withdrawal as indicated in Section 4.

9. Modifications of the terms

ESIGNUS may modify these conditions at any time, publishing changes on the Platform and/or notifying Users by email at ESIGNUS’s discretion. Continued use after notification implies acceptance; otherwise you must cease use.

10. Intellectual property

All Platform content (designs, marks, text, graphics, code, media, databases, software, combinations, and products) is owned by ESIGNUS or licensors. No reproduction, modification, distribution, public communication or derivative works without prior written permission. Access does not grant licence beyond a non‑exclusive, revocable, limited licence to use per these Terms. Report alleged infringements to ESIGNUS with supporting documentation.

11. Data processing and use of cookies

Personal data provided via the Platform or email will be processed by ESIGNUS as controller to address queries and send electronic notifications. See the Privacy Policy for details. ESIGNUS will maintain confidentiality and security measures. Visiting the Platform may involve non‑personal data collection via cookies for analytics; users must accept/reject/configure cookies via the banner. See the Cookie Policy.

Use of the Hardwallet does not imply processing of the User’s personal data by ESIGNUS for activation (including fingerprint). Personal data is processed for order fulfilment and follow‑up in accordance with the Privacy Policy.

12. Privacy and blockchain

Crypto‑asset purchases are recorded on public blockchains that may enable forensic analysis and potential de‑anonymisation when combined with other data. As decentralised, third‑party networks not controlled by ESIGNUS, we cannot delete or alter personal data on such networks. See the Privacy Policy for more information.

13. Applicable law and jurisdiction

Spanish law governs. For disputes, the parties submit to the Courts and Tribunals of Madrid (Spain), unless the dispute involves a financial transaction with a consumer, in which case the consumer’s domicile courts apply or an online complaint may be filed via http://ec.europa.eu/consumers/odr/.

14. Links

ESIGNUS does not control external sites linked from the Platform and assumes no responsibility for their content, availability, accuracy or legality. The inclusion of links does not imply association. Commercial hyperlinks to the Platform from third‑party sites without ESIGNUS’s express consent are prohibited.

15. Miscellaneous

If any clause is declared null by a competent authority, the remaining clauses remain in full force.

16. Transfer

The User may not assign its contractual position, this contract, or any rights or obligations hereunder to any third party.

17. Consent to electronic notifications

The User consents to electronic notifications about account status and Platform use. With consent, we may send push notifications to your device for updates and promotions; you may disable these in your device settings.
